To Customer Service Manager

On February 9, 2015 my brand new vehicle, a 2014 Hyundai Elantra, was involved in an early morning collision by a dependent of an USAA Insured Customer. Although the vehicle has been adequately repaired, it has still suffered a substantial loss in value as a result of being in the collision as a result of the negligence of your insured driver.

Being provided another UNDAMAGED brand new 2014 Hyundai Elantra would have been the ideal way to compensate me for my LOSS. However, I realize that action may be perceived as unrealistic. But never the less, what is particularly upsetting, in addition to the significant loss in value of my Brand New Car, is the fact that my 2014 Hyundai Elantra happens to be the first brand new vehicle that I have ever been able to purchase in my life โ€“ with extreme pride I drove my BRAND New 2014 Hyundai Elantra off the Dealershipโ€™s car lot with only 9 miles on it.

As I mentioned in my Diminished Claims Letter, I do not currently have a problem with the repair that was done on my car by the Body Shop at AutoNation Collision Center in Orlando, Fla. In fact, I believe that they did an outstanding job! However, only time will tell whether the vehicle will continue to perform similarly to that of a brand new vehicle.

In addition, for the safety of my young child it appears that his car seat must also be replaced. According to the manufacturer of the infant car seat that was in my car at the time of the collision: In their brochure, Graco Children's Products Inc. states โ€œREPLACE THE INFANT RESTRAINT AND BASE AFTER AN ACCIDENT OF ANY KIND. An accident can cause damage to the infant restraint that you cannot see.โ€

Through my previous letter I gave you notice of my intentions to make a claim for the inherent Diminution in Value that my vehicle has suffered as a result of your insuredโ€™s negligence. Although USAA appears to have taken a very strongly negative position against acknowledgement of Diminished Value Claims, Florida law requires that Insurance Companies operate in a Fair and Reasonable manner in trying to resolve insurance Claims. I had expected USAA to operate in a prompt and diligent manner.

It has been 2 weeks since I sent by Certified Mail from the USPS, to insure that you would indeed receive my Diminution in Value letter. As of today, I have not even received any phone call or written response to my Diminished Value Claims letter. I simply just want to reach a timely, just and fair settlement.

Your actions are neither prompt, fair nor reasonable!!
